APP's MMSEA Section 111 Reporting Service

Section 111 of the Medicare, Medicaid, and SCHIP Extension Act of 2007 (MMSEA) adds new mandatory reporting requirements for Liability Insurance (including Self-Insurance), No-Fault Insurance, and Workers' Compensation. These new reporting requirements are designed to aid the federal government identify payments made to Medicare recipients so that the Mandatory Secondary Payer (MSP) rules for Medicare benefits can be applied.

UPDATE: CMS has recently delayed the mandatory reporting date from April 1, 2010 to January 1, 2011! This means that there is still time to get your solution in place and avoid penalties!

Companies who are self-insured (including companies with an SIR or high deductible) for liability insurance, no-fault insurance, and worker's compensation are responsible for reporting claims information to the Centers for Medicare and Medicaid Services (CMS). The penalties for non-compliance are steep: $1,000 per claim per day. To further complicate matters, data must be transmitted to CMS in a specific electronic format that is very difficult to create by hand.
